The Small Business Administration today informed trade associations that Paycheck Protection Program funding has been exhausted and that the PPP application portal has now stopped accepting applications for new loans.

SBA said that it has reserved approximately $6 billion in funding for previously submitted loan applications subject to SBA hold codes that have yet to be resolved.

PPP Extension Act of 2021
This bill extends the Paycheck Protection Program, established to support small businesses in response to COVID-19 (i.e., coronavirus disease 2019), through June 30, 2021. Currently, the program is set to expire on March 31, 2021. The PPP Extension Act of 2021, which extends the program to May 31 instead of the current March 31 deadline and gives the SBA another 30 days to process loans. Next, the bill will be sent to President Joe Biden to be signed into law. The White House has indicated its support for extending the program to support small businesses.

Middlefield Bank will no longer be accepting new First and Second Draw PPP Applications to abide by the deadline set by Congress. However, the House of Representatives has voted to extend the deadline to apply for PPP loans to May 31st. The legislation is now awaiting action in the Senate.  If the legislation passes, Middlefield Bank will resume PPP loan applications. Please check back for updates.

PPP Loan Forgiveness Amounts of $50,000.01-$150,000.00
The US Small Business Administration (SBA) and Treasury published an updated Paycheck Protection Program (PPP) loan forgiveness guidance and forms, including a one-page application for borrowers that received a PPP loan of $150,000 or less.
 
That form, called the PPP Loan Forgiveness Application Form 3508S, can be used by borrowers that received a PPP loan of $150,000 or less and will be completed on Middlefield Bank’s secure online portal. We will have this form updated for those under $150,000 to use by Friday, January 29th.  A note will be posted on this page to confirm the form is ready

Middlefield Bank will be participating in the continuation of the Payroll Protection Program (PPP) and will begin accepting new “first draw” and “second draw” applications as early as the SBA allows. An institution of our size will likely be allowed to begin accepting applications beginning on Friday, January 15th at 11am. However, our intended date of acceptance of applications is contingent upon pending SBA guidance, so it may be subject to change.

We will use a secure online application portal and the link to apply will be located on this webpage. Middlefield Bank will not accept paper or email applications. You will need a valid email address to apply.
 
Upon entering the secure online portal, you may see both PPP applications for the first or second draw and a section for the PPP loan forgiveness application. We kindly ask that if you have not received an invitation from us to apply for forgiveness that you do not access the forgiveness section at this time. Our staggered rollout for forgiveness will allow us to service the second draws while we continue to move through our list. To help ensure delivery of important PPP update emails to your inbox, please add MBinfo@middlefieldbank.com to your email contacts.
 
We will fund your PPP loan to a Middlefield Bank business checking account registered using the same EIN number as the applicant borrower. If you already have a business checking with us, you do not need to open a secondary account. For new business clients, you can get started with a business checking account, by contacting your PPP Lender, calling our Customer Support Center at 888-801-1666, or submitting a PPP Business Checking form here: www.middlefieldbank.bank/pppchecking.
 
Application documentation requirements are based upon the amount of the loan and are subject to SBA Guidelines; all loan requests submitted to Middlefield Bank are subject to a completed application, Middlefield Bank acceptance, SBA approval, provision of funds, and loan closing. Applying is not a guarantee of funding as program funds are limited. The PPP program is open until March 31, 2021, or until all the funds are expended, whichever occurs first.

About the PPP Second Draw Loans:
The second draw now allows eligible borrowers that previously received a PPP loan to apply for a Second Draw PPP Loan with the same general loan terms as their First Draw PPP Loan. Second Draw PPP Loans can be used to help fund payroll costs, including benefits. Funds can also be used to pay for mortgage interest, rent, utilities, worker protection costs related to COVID-19, uninsured property damage costs caused by looting or vandalism during 2020, and certain supplier costs and expenses for operations.
 
Targeted Eligibility:
A borrower is generally eligible for a Second Draw PPP Loan if the borrower:
• Previously received a First Draw PPP Loan and will or has used the full amount only for authorized uses;
• Has no more than 300 employees; and
• Can demonstrate at least a 25% reduction in gross receipts between comparable quarters in 2019 and 2020.

As of December 21st, Congress passed a new piece of financial assistance legislation that includes another round of the Payroll Protection Program (PPP). However, the legislation is still unsigned by the President and may not become law.
 
If or when the legislation is signed, it will take time before the program is fully defined. The SBA has not issued any guidance as to amounts, terms, or qualifying conditions. Once the new program's parameters are defined, we will send another email to inform you of its details.
 
Additionally, the legislation instructs the SBA to create a simplified PPP forgiveness application for small businesses whose PPP loans were less than $150,000. The SBA may or may not use the existing 3508S form that is currently being used for PPP loans less than $50,000. That has yet to be determined and we will inform you on this matter as well.
 
We understand that there are questions about another round of PPP and changes to the forgiveness application. Until further information is available, we are not able to answer questions about the new program and we cannot reserve funds or an application spot. Please continue to check your email for our next communication. 

Middlefield Bank’s PPP Loan Forgiveness will continue with our staggered rollout. If you have yet to receive an email invitation to apply for forgiveness, you will over the next few months.

Middlefield Bank will have a staggered rollout for PPP Forgiveness Applications based on loan amounts and by loan dates to allow for processing speed and to have team members available to address and assist customers with any questions.

We understand that businesses are anxious to apply and there are a few common questions. 

1. When is the deadline to apply for forgiveness?

The SBA updated their PPP Loan Forgiveness FAQs on 10/13 in response to the question about forgiveness application deadline they stated in questions 3 and 4: Borrowers may submit a loan forgiveness application any time before the maturity date of the loan, which is either two or five years from the loan’s origination, depending on the borrower’s agreement. Loan payments are deferred for 10 months after the last day of each borrower’s loan forgiveness covered period.

2. What about year-end tax filings?

The U.S. Treasury Department and Internal Revenue Service (IRS) on 11/18 released guidance clarifying the tax treatment of expenses where a Paycheck Protection Program (PPP) loan has not been forgiven by the end of the year the loan was received. Middlefield Bank is advising our borrowers to please speak to their tax accountant with any questions about year-end filings.
